General Terms and Conditions (GTC)
1. Scope
These GTC apply to all services of myrecruity GmbH, Weihburggasse 5/3, 1010 Vienna ("myrecruity"), towards users of the platform and services (talents, companies, recruitment agencies). Deviating terms of the user apply only with express written consent.
2. Services
myrecruity operates an AI-supported platform for placing IT professionals and provides companies and recruitment agencies with related services. Matching is AI-supported; every decision relevant to the data subject — in particular the introduction to a company — is reviewed and confirmed by humans (human in the loop). Details on automated processing and profiling can be found in the Privacy Policy. Scope and features may change in the course of ongoing development.
3. Early Access / Beta
Parts of the services are provided as part of an early-access/pilot operation. These may be limited in functionality and availability; there is no entitlement to specific features or uninterrupted availability.
4. Registration & user obligations
Registration is required for certain services. Users warrant that they provide truthful and complete information and keep their access credentials confidential. Users must not use the platform in an abusive, unlawful or rights-infringing manner.
5. Fees
For talents, the use of the placement service is free of charge. Services for companies and agencies are subject to a separate agreement; the respective terms are agreed individually. Unless stated otherwise, fees are exclusive of statutory VAT.
6. Term & termination
Unless otherwise agreed, the usage relationship may be terminated by either party at any time. Separately agreed paid services are governed by the respective individual agreement.
7. Right of withdrawal for consumers (FAGG)
Consumers within the meaning of the Austrian Consumer Protection Act (in particular talents) have the right to withdraw from the distance contract within 14 days without giving reasons. The withdrawal period is 14 days from the day of conclusion of the contract.
To exercise the right of withdrawal, a clear statement (e.g. by email to office@myrecruity.com) of the decision to withdraw from the contract is sufficient. You may use the model withdrawal form attached at the end of these GTC; its use is not mandatory. To meet the withdrawal deadline, it is sufficient to send the statement in time.
As the use of the platform is free of charge for talents, no payment or compensation obligations arise in the event of withdrawal. If, at the consumer's express request, myrecruity begins providing the service before the withdrawal period expires, the right of withdrawal remains unaffected as long as no paid service has been fully performed.
8. Data protection
The processing of personal data is carried out in accordance with our Privacy Policy (see /datenschutz).
9. Liability
myrecruity is liable in accordance with statutory provisions for intent and gross negligence. For slight negligence, liability is excluded to the extent legally permissible; this does not apply to personal injury. myrecruity gives no warranty for the conclusion of an employment relationship or placement, or for the suitability, accuracy or completeness of information provided by third parties.
10. Online dispute resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. myrecruity is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Changes to the GTC
myrecruity may amend these GTC for objective reasons. Registered users will be informed of material changes in good time.
12. Final provisions
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is — to the extent legally permissible — the court with subject-matter jurisdiction in Vienna. Mandatory consumer protection provisions remain unaffected. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
